A unanimous three-judge panel of the DC Circuit Court of Appeals ruled that the Energy Department’s emergency declaration used to keep Michigan’s J.H. Campbell Generating Plant open violated the governing statute. The reasoning could apply to other coal-plant closures blocked by the department.
